(“Awake,” “we,” “us”, “our”)
provides a global limited product warranty (“Warranty”) on the terms and conditions set out herein.
The Warranty applies to all Awake electronic surfboards, eFoils, and foiling jet skis (the “Boards”).
Awake guarantees that the Boards will be free from defects in materials and workmanship under Normal Recreational Use for the periods defined below.
This Warranty applies globally to all Boards sold by us (including our subsidiaries) or one of our Partners provided that you have registered your purchase as required in this Warranty.
This Warranty does not limit or replace any rights you may have under applicable mandatory laws, including mandatory consumer laws if you are a consumer.
2. Definitions
- “Authorized Service Provider”: A service provider approved by Awake.
- “Normal Recreational Use”: Recreational use of the Board in water environments (fresh or saltwater) and in accordance with this Warranty.
- “Partner” an authorized reseller of Boards appointed by Awake.
3. Mandatory Registration for Warranty of Boards
For a Board to be covered by the Warranty, the Board must be unused and registered for Warranty coverage with Awake within 8 weeks after it was purchased from Awake or a Partner.
If the Board was not registered for Warranty coverage with Awake when purchased, the Board can be registered in the Awake Link application up to 8 weeks after it was purchased.
If the ownership of a Board is transferred, the Warranty - if duly registered - can be transferred to the new owner. Please reach out to support@awakeboards.com to perform a transfer of Warranty. We note that in the case of a transfer of Warranty, the warranty period is only transferred, not renewed or extended.
4. Warranty Periods
The Warranty period begins on the original date of purchase from us or a Partner.
The Warranty period on the Board is 24 months. However, for batteries, the warranty period is 24 months or 300 charge cycles (whichever occurs first). Further, no warranty claims can be made on batteries that have a battery capacity of 70 % or more of the original capacity.
For a Warranty claim to be valid, the claim must be made towards Awake, within the Warranty period and as otherwise set out in this Warranty.
5. Warranty Scope and Warranty Exclusions
5.1 Warranty Scope and Conditions
Unless otherwise set out herein, the Warranty covers defects in the Board in materials and workmanship under Normal Recreational Use.
In addition to what is otherwise stated in the Warranty, the Warranty is conditioned on all instructions in the user manual being followed, including on cleaning, storage, service, maintenance and repairs, and installation and updates of software every month (or more frequently if stated in the relevant manual).
For a Warranty claim to be valid, the claim must be made within two (2) months from when you became aware, or should reasonably have become aware, of the defect or damage.
5.2 Warranty Exclusions
This Warranty does not cover:
- Defects or damage that are caused by misuse (including willful misconduct, negligent use, reckless use or malicious or improper handling or storage, operation outside specified limits, use of the Board for which it is not designed, use in unsafe locations and/or unsafe conditions or failure to follow instructions), vandalism, interference, or intensive commercial use;
- Defects or damage resulting from collisions, drops, transport damage, or structural damage caused by external forces;
- Defects or damage resulting from maintenance, care, and repair that are not in accordance or comply with Awake's procedures and manuals; including when the Board has been repaired or modified by someone other than by Awake’s personnel or a person authorized by Awake to do so (such as an Authorized Service Provider);
- Defects or damage caused by the use of accessories, including chargers, or parts, components or materials that are not manufactured, or otherwise approved by Awake; and
- Defects or damage in a Board in which the seal of any kind is broken or otherwise tampered with or where the carbon fiber hull has been compromised.
- Changes to specifications, manuals, instructions etc.

6. Warranty Claim Process
6.1 Process
If you believe you have claim under this Warranty, please contact Awake following the instructions below:
- Submit a support request via the Awake Link App on a phone using either an iOS or Android operating system;
- Submit a support request via the support form at awakeboards.com/support;
- Send an email to support@awakeboards.com.
6.2 Documentation
Awake will require the following documentation to verify and support you:
- Copy of the receipt of purchase or the delivery receipt;
- The invoice number of the purchase;
- The name and address of the purchaser;
- The purchaser’s e-mail address and phone number;
- A description of the defect;
- If required by Awake; photos, videos, and other material relating to the defect; and
- Any further information reasonably requested by Awake to verify and support the Warranty claim.
6.3 Determinations
All determinations regarding Warranty claims will be made by Awake in accordance with this Warranty document and will be final.
6.4 Invalid Warranty Claims
If we receive a Board submitted under a Warranty claim and we determine, upon a thorough inspection, that it is not a valid Warranty claim, we will require that you pay for the costs of shipping the Board both to Awake and the return shipment back to you before we release your Board. We will also advise you of any service charges if we determine that a service is necessary for the Board, and we will not conduct any service work until you have first approved this and prepaid an invoice for such service.
7. Warranty Remedies
7.1 Valid Warranty Claims
If a valid claim is confirmed, Awake will, at its discretion:
- Repair the defect in the Board or defective component free of charge; or
- Replace the Board or defective component (new or refurbished) free of charge.
Awake may provide repairs or replacements via an Authorized Service Provider.
8. Shipping and Service
Awake may require that you, at your own cost, ship the defective Board and/component to Awake or an Authorized Service Provider, for repair, replacement or refund, cf. Article 7 above.
Awake will cover the shipping costs of the repaired or replaced Board or component to, at its discretion, you or an Authorized Service Partner of your choice, where you must pick it up.
9. GDRP
Any personal data provided in connection with product registration and warranty service will be processed in accordance with our privacy policy, which is available here.
10. Limitation of Liability
Liability is limited to the original purchase price of the Board.
To the maximum extent permitted by applicable law, Awake is not liable for indirect, incidental, or consequential damages, including loss of use.
Nothing in this Warranty excludes liability for death or personal injury or fraud or fraudulent misrepresentation.
Nothing in this Warranty excludes or restricts statutory guarantees that cannot be excluded under mandatory local laws and regulations.
11. Governing Law and Jurisdiction
This warranty shall be governed by the laws of Denmark, unless applicable mandatory local consumer law requires otherwise. Danish choice of law provisions and the Convention on the International Sales of Goods shall not apply.
Any dispute arising out of or in connection with this Warranty shall be subject to the exclusive jurisdiction of the Danish courts, unless applicable mandatory local consumer law requires otherwise.
